When it comes to estate planning, most people think about family, investments, and property—but what about our pets? For many, pets are family too. Yet they’re often overlooked in legal documents, leaving their future uncertain if something happens to you.

In New Jersey, pets are legally considered personal property. That means without specific instructions in your will or trust, your beloved dog, cat, or cockatoo could end up with someone you never intended—or even in a shelter.

The first step in planning for your pet is deciding who you trust to care for them. Choose someone who genuinely loves animals and is willing to take on the responsibility. Talk to them first, and name them clearly in your will as your pet’s guardian.

Second, consider setting aside money for your pet’s care. You can leave a specific dollar amount or create a pet trust, which legally requires that funds be used for your pet’s food, medical care, and other needs. This is especially important for pets with long life expectancies (like parrots) or chronic health conditions. You can even obtain life insurance to benefit the trust for the care of your pet.

In your. will or trust you can provide detailed instructions for the care of your pet. Do they need a special diet? Daily medications? A favorite toy or bedtime routine? Including these instructions helps your chosen caretaker maintain the lifestyle your pet is used to.

Finally, keep a list of your pet’s vet records, medications, and emergency contacts with your estate documents.

Your pet gives you unconditional love every day. Making a plan for their future is one of the best gifts you can give in return.
